Welcome to AI Food Habit Coach ("the App," "we," "our," or "us"). By accessing or using the App, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not use the App.

1. Acceptance of Terms

By creating an account, downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will not use the App for any illegal or unauthorized purpose
• You will comply with all applicable laws and regulations

3. Account Registration

3.1 Account Creation

To use certain features of the App, you must create an account. You may register using:

• Email and password
• Apple Sign In
• Google Sign In

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

3.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4. Subscription Plans and Billing

4.1 Available Plans

• Free Plan: Limited AI analyses per day
• Premium Plan: Unlimited AI analyses

4.2 Billing

• Subscriptions are billed monthly or annually as selected
• Charges are processed through Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled 24 hours before the end of the current period
• Refunds are subject to Apple's and Google's refund policies

4.3 Changes to Pricing

We reserve the right to modify subscription prices. You will be notified of price changes in advance, and changes will apply to subsequent billing cycles.

5. Permitted Use

You may use the App for personal, non-commercial purposes only. Permitted uses include:

• Logging and tracking your meals
• Receiving AI-powered nutritional analysis and insights
• Setting and tracking health habits
• Monitoring your progress toward health goals
• Using voice input for meal descriptions

6. Prohibited Use

You agree NOT to:

• Use the App for any unlawful purpose
• Upload inappropriate, offensive, or harmful content
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems (bots) to access the App
• Share your account with others
• Attempt to bypass any security measures
• Misuse or abuse the AI features (spam, excessive requests)
• Upload photos that are not food-related without legitimate purpose
• Interfere with or disrupt the App's operation

7. AI-Generated Content

7.1 Nature of AI Analysis

Our App uses artificial intelligence (OpenAI's GPT-4 Vision) to analyze meal photos and provide nutritional estimates. You acknowledge that:

• AI analysis is an estimation and may not be 100% accurate
• Results depend on photo quality and meal visibility
• AI suggestions are for informational purposes only
• AI cannot account for all ingredients, preparation methods, or portion sizes
• Results should not be solely relied upon for medical or dietary decisions

7.2 No Medical Advice

The App provides general information about nutrition and healthy habits. It does NOT provide medical advice, diagnosis, or treatment. You should:

• Consult with healthcare professionals before making significant dietary changes
• Not rely solely on the App for managing medical conditions
• Seek immediate medical attention for any health emergencies

8. Content Ownership and License

8.1 Your Content

You retain ownership of any content you upload (photos, descriptions, etc.). By uploading content, you grant us:

• A non-exclusive, worldwide license to use, store, and process your content
• Permission to use uploaded photos for AI analysis
• The right to display your content back to you within the App

8.2 Our Content

All App content, including design, features, text, graphics, and software, is owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without permission.

9. Data Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

10. Third-Party Services

The App integrates with third-party services:

• OpenAI: For AI-powered meal analysis
• Apple Sign In: For authentication
• Google Sign In: For authentication

Your use of these services is subject to their respective terms and privacy policies.

11. Termination

11.1 By You

You may terminate your account at any time by:

• Deleting your account through the App settings
• Contacting our support team

11.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or abusive behavior
• Required by law or legal process
• We discontinue the App

11.3 Effects of Termination

• Your right to use the App immediately ceases
• Your data will be deleted per our retention policy
• Paid subscriptions are non-refundable except as required by law

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, reliability, or completeness of AI-generated content
• Fitness for a particular purpose
• Uninterrupted or error-free operation
• Security of data transmission

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Damages arising from your use or inability to use the App
• Reliance on AI-generated content
• Health outcomes or decisions made based on App information

14. Indemnification

You agree to indemnify and hold harmless AI Food Habit Coach, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
